Democracy for Federation of St Kitts and Nevis suffers crushing blow on legal technicality despite compelling evidence of fraud!

July 31, 2020

Fearful of losing the June 5th 2020 elections, the Harris-led UNITY concoction resorted to widespread abuse of office, plundering of state funds while they wantonly and disgracefully robbed Kittitians of free and fair elections. UNITY resorted to extensive bribery, electoral fraud and massive instances of corruption and list padding. These gross irregularities resulted in UNITY assuming government.

The St Kitts and Nevis Labour Party (SKNLP) rightfully filed petitions with substantive evidence based on eye-witness accounts highlighting the extent to which Harris and his counterparts bought the election in a massive “payments for vote” scheme abusing our patrimony in exchange for votes. However, without the benefit of having the substantive matters heard in court SKNLP has been prevented from pursuing the matter on a simple legal technicality. This is indeed an alarming and disappointing situation for the SKNLP. The June 5th General Election was neither free, fair or free from fear.  It was not conducted on a level playing field. A New York Times article entitled “Latin America is Facing a Decline in Democracy under the Pandemic” published on July 29, 2020, cited the 24-hr lockdown as one of the main impediments hampering opposition efforts to connect with voters while candidates on the government side were allowed to do so.

The SNKLP shares in the disappointment of our overwhelming majority of supporters and we remain resolute in our position that the elections were stolen and fraudulent. The tactics employed have left us with a fractured and deeply divided government and country which needs rescuing. SKNLP expresses our thanks to all our supporters and those who continue to stand on the side of truth, justice and democracy. We remind you that the fight for democracy will be endless for the citizens of St Kitts and Nevis.

SKNLP will be the guardians of our democracy. We will not rest until the will of the majority of the people is recognized.

Let Justice Reign

Dr. Terrance Drew’s attorneys responded to DPP Valston Graham’s request for full disclosure of evidence in a detailed letter on February 25, 2021. Three days after the request was made unexpected in the last court hearing on February 22, 2021.

The letter indicated that the DPP’s office did not “send formal and written correspondence to the Magistrate’s Court indicating your intention to make representations in the matter, with such correspondence being copied to Counsel for the parties.” The letter additionally indicated that apart from not receiving proper notice via correspondence, not even a phone call was received to indicate the change. The attorneys were then basically ambushed the morning of the court matter.

The letter further stated that when the case was first appeared on the Magistrate court list for hearing on February 1, 2021 before His Honour Justice Fitzroy Eddy “there was no intervention, appearance or representation made by you (DPP Graham) or any other representative of your office. Now suddenly, we are faced with this intervention.”

Justice Eddy was asked to recuse himself because of his close affiliations with the People’s Action Movement of which he did. However, now DPP Graham although openly revealing that he has close ties with the leader of the same party, has opted to take over the case completely void of a moral compass. The defendant is a sitting member of government and the member of the People’s Action Movement.

In the press conference held by the DPP he spun the narrative of his alleged impartiality and objectivity by using the case of Leon Natta as an example. However, what he failed to outline to the public was that “the decision to withdraw the matter came against the background where it had only been made after the defence had become aware of the names of others, including a Minister of Government who had not renewed their gun licences and it was revealed that the charging of Mr. Natta was outside of the time limit for so doing.”

The DPP attempted to trivialize the case of Dr. Drew versus Mr. Hamilton, insinuating that there was no real basis for the charges after which he invited one of the journalists to judge for himself. The letter highlighted that the “underlying dismissive tone in the press conference coupled with your associations and relationships cumulatively create significant doubt in our client’s mind as to your ability to fairly review the matter” and rightfully so. The mannerism of the DPP at the press conference in no way indicated fairness will be meted out at the upcoming hearing.

The DPP needs to step down and let the matter be dealt with fairly and justly.

Chairman of the St. Kitts-Nevis Labour Party, Dr. Terrance Drew, on Freedom FM Issues held Friday February 26 gave clarity to the matter regarding the criminal court case brought against Hon. Eugene Hamilton on the charge of bribery and treating.

Dr. Drew made clear several allegations that were made by the DPP who insinuated that Dr. Drew’s attorneys may not be adequately prepared and highlighted what actually took place at the recent court hearing held on February 23, 2021 indicating that his attorneys did not in any way decline sharing the information surrounding the case with the DPP.
